Nature of case

The Court considered Alstom’s application for an interim injunction to restrain Eurostar from entering into a contract with Siemens for the design, supply and maintenance of high speed trains. Alstom claimed that Eurostar was in breach of the Utilities Contracts Regulations 2006. The Court decided that whilst there was a serious issue to be tried and damages was not an adequate remedy, on the balance of convenience the application should not be granted.
