Nature of case
The Claimant applied for summary judgment on a claim under a personal guarantee. However, Ramsey, J. refused summary judgment as the Defendant (the guarantor) had a real prospect of successfully defending the claim on the basis that the guarantee was subject to a condition that was not fulfilled and that he was not bound by an Adjudicator’s decision in relation to his personal obligations under the guarantee.
