Nature of case
Trial of preliminary issues in connection with fire damage to a property alleged to have been caused by the negligence of a steelwork sub-sub-contractor.  The preliminary issues related to (a) whether, in light of the exclusions and insurance provisions in the main contract, the sub-contractor owed the employer a duty of care and (b) consideration of the rule in Biggin v Permanite.
