Nature of case
The court had to decide on the grant of an interim injunction
under s.44(5) of the Arbitration Act 1996 and whether an
application could be granted to stop the call of a performance
bond. It was held that the court should normally apply the
same principles for an application under s.44 as if it had come
before it in legal proceedings.
