Nature of case
The TCC judge considered whether pursuant to section 69 of the Arbitration Act 1996 the applicant was entitled to permission to appeal a point of law of an arbitration decision and to set aside the award on grounds that the arbitrator had been guilty of serious irregularities pursuant to section 68. The judge held that, in the circumstances, the arbitrator had not been obviously wrong in his construction of words in a contract describing the fee payable for certain work by a building surveyor, and even if he had been, it had not been shown that his alleged error would or could have affected the rights of the parties.
