Nature of case
An option agreement on a residential development site was held
to be a development agreement within the meaning of the
Construction Contracts Exclusion Order 1998 and thus excluded from
the operation of the adjudication provisions of the HGCR Act.
It therefore followed that the adjudicator had no jurisdiction and
the adjudication was invalid.
