Nature of case
The Court considered whether enforcement of an adjudicator’s decision should be refused on the basis that there was no dispute in being at the date of the notice of adjudication; that it was impossible for the adjudication to be conducted fairly and impartially; that it was impossible to resolve the dispute fairly by adjudication; and that the adjudicator had made an accidental slip which the Court ought to correct or invite the adjudicator to correct.
