Oil and Gas Plants

Introduction

Many members of Keating Chambers have extensive experience of advising in disputes relating to the production and processing of oil and gas. While particular disputes have their own characteristics and individual difficulties, this means that there is a high degree of understanding of the energy industries and their specific needs. The following recent examples show the breadth and depth of oil and gas facility experience available from Keating Chambers, both domestically and internationally. The work undertaken by members of Chambers is chiefly advice and advocacy in arbitration and other proceedings and appointment as arbitrator or other tribunal member.

Advice and Advocacy

  • Acting for a Japanese/UK Joint Venture contractor defending sub-contractors’ claims in a UNCITRAL arbitration arising out of the construction of a LNG plant in the Middle East.

  • Advising a US design and construct contractor on a series of disputes in the Middle East arising out of an oil separation plant.

  • Acting as counsel in a US$100 million dispute relating to a gas-processing plant in the Middle East.

  • Undertaking pleadings and interlocutory work for the Government of a Caribbean state in an ICC arbitration relating to a petro-chemical plant.

  • Advising in an international arbitration on disputes concerning a petro-chemical plant in the Slovak Republic.

  • Acting as advocate for an English contractor in relation to a US$200 million dispute arising out of a Middle East oil and gas project. The arbitration was based in Cairo and governed by Egyptian law.

  • Advising and drafting pleadings for a Korean contractor in an ICC arbitration relating to an oil refinery project in Central America. The value of the sums in dispute exceeded US$1 billion.

  • Advising in an international arbitration on quality of supply and ‘take or pay’ provisions in respect of gas production in the South China Sea.

  • Advising a UK client in connection with termination of a gas infrastructure development project in Bangladesh.

Dispute Resolution Appointment

  • Appointed as Chairman of an ICC tribunal dealing with arbitration of disputes, including termination, on a natural gas process plant in Greece.

  • Acted as presiding Arbitrator in an arbitration concerning jetties and marine works for a LNG installation in the Middle East.

  • Appointed as Chairman of an ICC arbitration tribunal on disputes arising from construction of a substantial oil-transfer facility in North Africa.

Examples of other involvement in Oil and Gas Work

  • Advice to an oil and gas company on contract documentation relating to the opening up of a new oil-field in the North Sea.

  • Acting for a sub-contractor in an arbitration concerning an oil exploration project in Kazakhstan.

  • Acting for a Baltic oil company in an ICC arbitration defending claims made by a Swedish oil exploration company in respect of an oil exploration rights and the value of assets. 

  • Appointment as member of a three-man ICC arbitral tribunal hearing a dispute related to off-shore and mainland oil exploration in the Mediterranean.

  • Appearing in litigation for a major contractor at the trial of a £multi-million process engineering dispute arising from disruption to the construction of a barge in a North Sea oil project.

  • Appearing for the owners in Technology and Construction Court proceedings concerning conversion works undertaken to a North Sea oil industry vessel.

  • Instructed in a US$100 million LCIA arbitration in relation to construction in Singapore of a storage vessel for the Norwegian oil fields
